Terms of Service

1. Acceptance of Terms

By registering an account or using any part of the Hotel Booking Nairobi platform ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

These terms apply to hotel operators using app.hbnairobi.com and guests using booking.hbnairobi.com.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

Each subscription is intended for use by a single hotel property. Use of the same account across multiple unaffiliated properties requires a Multi-Property add-on subscription.

3. Subscription and Billing

The Service is provided on a monthly subscription basis. Fees are charged in Kenyan Shillings (KES) as stated on our pricing page.

  • A 14-day free trial is available for new accounts — no credit card required during the trial period.
  • After the trial, a valid subscription is required to continue using the Service.
  • Subscription fees are non-refundable unless required by applicable law.
  • We reserve the right to modify pricing with 30 days' notice to existing subscribers.
  • Add-on services (additional properties, etc.) are billed separately and are subject to the same terms.

4. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service to process fraudulent bookings or payments
  • Attempt to reverse-engineer, copy, or resell any part of the platform
  • Upload malicious code, viruses, or files that may damage the system
  • Share your account credentials with unauthorised persons
  • Use automated tools to scrape or overload the platform

5. Hotel Operators' Responsibilities

As a hotel operator, you are responsible for:

  • The accuracy of all hotel information, room rates, and availability listed on the booking portal
  • Honouring confirmed bookings made through the platform
  • Compliance with all applicable Kenyan laws including Tourism Act regulations and data protection obligations
  • Any guest data entered into the system in connection with your hotel operations
  • Ensuring your hotel listing does not contain misleading or fraudulent information

6. Public Listing on booking.hbnairobi.com

Hotel operators may apply to list their property on the public booking portal. Approval is at our sole discretion. We reserve the right to remove any listing that:

  • Contains inaccurate or misleading information
  • Receives verified complaints from guests
  • Violates any of these Terms

The listing fee is included in the base subscription. No commission is charged on bookings.

7. Limitation of Liability

To the maximum extent permitted by law, HB Nairobi and SomICT shall not be liable for:

  • Indirect, incidental, or consequential losses arising from use of the Service
  • Loss of revenue or business resulting from system downtime
  • Actions or omissions of hotel operators or their staff
  • Disputes between hotel operators and their guests

Our total liability in any calendar month shall not exceed the subscription fee paid by you in that month.

8. Termination

You may cancel your subscription at any time from within your account settings. Access to the Service will continue until the end of the current billing period.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

9. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
